Off-premise advertising signs issue updated
Seven year amortization period ends July 1

Earlier this month letters were sent to all property owners and sign companies regarding off-premise advertising signs within the town's jurisdiction.

The Town's Ordinance Section dealing with this issue was adopted April 11, 2000. It prohibits off-premise advertising signs. Signs existing on April 11, 2000 were provided with a seven year amortization period to permit ongoing rental income as compensation for removal of the signs at the end of that period.

That period expires July 1, 2007. The town has been notified by attorney Albert T. Sneed, Jr. of the Van Winkle Law Firm, Asheville N.C., that he is representing Allison Outdoor Advertising of Sylva, N.C. in this matter.

The issue seems to involve what constitutes the just compensation required under N.C. General Statutes and if the signs in question qualify for protection under the just compensation provisions.

The matter has been referred to Town Attorney Merinda S. Woody.
